of Karnataka Service (Conditions of Service

and Recruitment) (I amendment) Rules,

2024.

In exercise of powers conferred under Article 229 (1) and (2) of the

Constitution of India, read with Rule 7 and 8 of the High Court of Karnataka

Service (Conditions of Service and Recruitment) Rules, 1973, and all other powers

enabling thereunto, Hon’ble the Chief Justice proposes to make the following rules

to amend the High Court of Karnataka Service (Conditions of Service and

Recruitment) Rules, 1973, (hereinafter referred to as the “Principal Rules”).

The Director, Ministry of Law and Justice (Dept of Justice), Government of

India, vide letter No.F No.11015/3/2014-Jus-II dated 02.12.2014 had intimated

that one of the components of the 13th Finance Commission grant for improvement

in delivery of justice was the funding for creation of posts of Court Managers. As

per guidelines circulated vide circular No.31 (30) FCD/2010 dated 20.9.2010, ₹300

crores were allocated for employment of professionally qualified Court Managers in

each Judicial District to assist the Principal District & Session Judges. In

addition, two Court Managers for High Court and one for each bench of High Court

were to be employed. Guidelines also included the suggested functions,

responsibilities & qualifications.

Accordingly, as per the action plan under the recommendation of the 13th

Finance Commission, Government of India, one of the initiatives for improvement

of Justice Delivery System was appointment of Court Managers. Hence, an Action

Plan was prepared by the High Court of Karnataka, Bengaluru for the appointment

of Court Managers and was forwarded to the Government of Karnataka for

approval. In the said action plan it was proposed to fill up 04 Court Managers for

the High Court of Karnataka. In view of the same, the Government of Karnataka

has accorded approval for appointment of Court Managers vide G.O. No.FD 1659 F 

Secy (B&R) 2011 and applications were called for by the High Court of Karnataka 

from eligible candidates vide this office Notification No.HCE 687/2011 dated 

31.05.2011. 

In pursuance of the said Notification, the Court Managers who are presently 

working in High Court of Karnataka were selected and appointed as such vide 

Notification No.HCE 687/2011 dated 21.06.2013 on contract basis with a 

remuneration of ₹50,000/- (Rupees Fifty thousand only) to be increased by 10% on 

every completion of one year. 

The Hon’ble Supreme Court of India vide Order dated 02.08.2018 passed on 

the Interlocutory Application No. 278/2010 in Writ Petition (Civil) No. 1022/1989 

(All India Judges Association & Ors Vs. Union of India & Ors case) directed to 

appoint professionally qualified Court Managers, preferably with an MBA degree, 

to render assistance in performing the Court Administration and that the services 

of any person already working as a Court Manager should be regularized, as their 

assistance is required for Court Administration. Thereafter, services are continued 

as per the order dated 16.11.2018 passed in WP.No.13380/2018 by this Hon’ble 

High Court.
